By accessing and using the website at www.igtusa.com (the “Site”), and/or by utilizing any services provided by Innovative Global Technologies Inc. (IGT) (collectively, the “Services”), you agree to be bound by these Terms of Service (“ToS”) and all terms incorporated herein by reference. If you do not agree to these ToS, you must not access or use the Site or the Services.
IGT reserves the right to modify, amend, or replace these ToS at any time. We will notify users of significant changes by posting the new ToS on the Site or by sending an email notification. Your continued use of the Site or Services following the posting of any changes constitutes acceptance of those changes.
The specific terms, deliverables, timelines, and fees for any project will be outlined in a separate written agreement, such as a **Statement of Work (SOW)** or Service Agreement, which, once executed, will supersede any conflicting terms in this ToS.
The Site, its original content, features, and functionality (including but not limited to text, graphics, logos, and code) are and will remain the exclusive property of IGT and its licensors. Ownership of the intellectual property created specifically for the Client as part of a paid service will be defined in the governing SOW or Service Agreement.
All fees for Services will be specified in the relevant SOW or project agreement. Unless explicitly stated otherwise in a written SOW, all fees are non-refundable. IGT reserves the right to suspend Services for overdue payments.
The Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis. IGT makes no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, or materials included on the Site. To the full extent permissible by applicable law, IGT disclaims all warranties.
In no event shall IGT, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, resulting from your access to or use of or inability to access or use the Site or Services.
These ToS shall be governed and construed in accordance with the laws of the **State of New Jersey, United States**, without regard to its conflict of law provisions. Any dispute shall be resolved exclusively in the state or federal courts located in **Bergen County, New Jersey.**
